After Happel and Smith petitioned the North Carolina Supreme Court, the court agreed on May 23 to hear arguments about whether the PREP Act protects the defendants from liability and suit and preempts North Carolina’s laws governing the plaintiffs’ claims. A hearing has yet to be scheduled.

CHD’s amicus brief argues that the lower courts were wrong to interpret the PREP Act as they did because the U.S. Constitution does not give Congress authority to nullify state laws governing the in-state activities that gave rise to the plaintiffs’ claims. The brief states:

An amicus brief is filed by non-parties to a litigation to provide information that has a bearing on the issues and assist the court in reaching the correct decision. It comes from the Latin term “amicus curiae,” which means “friend of the court.”

Risa Evans, the CHD attorney who wrote the brief, told The Defender she thinks it’s wrong to leave parents with no legal recourse after a child is injected with an EUA product over the child’s express objection and without parental consent.

“Parents must have a way to hold the wrongdoers accountable,” Evans said. “I hope the North Carolina Supreme Court agrees that the U.S. Constitution prohibits this result.”

Steven Walker, attorney for the plaintiffs, told The Defender the case is important “because it impacts the ability of parents to direct the medical care that their child receives.”

Many of you are already aware that the Children’s Health Defense Vaxxed-Unvaxxed bus made two stops in North Carolina at the end of October as they continue to traverse the country collecting stories from individuals and loved ones of individuals who have been negatively impacted by vaccines, vaccine mandates, and hospital protocols. Another purpose of the tour was to hear from parents whose children are not vaccinated. All of these stories are linked throughout this article.

Several of our HEALNC leaders had the honor of working alongside the Children’s Health Defense Team when they stopped in Winston-Salem and Charlotte. Our team helped schedule the interviews and had the opportunity to speak to all of the interviewees during their visit to the bus. It was two moving and meaningful days filled with every emotion. We commiserated, consoled, and even cried with people who had lost family members or had been harmed by vaccines or hospital protocols. We celebrated their courage to record their stories and broadcast them across the world on CHD TV.

CHD and HEALNC were welcomed by two courageous church leaders in Winston-Salem and Charlotte, who proudly hosted the bus so that these important stories could be told. Debbie Lanier, Unafraid, with Hope Community Church in Winston-Salem, stated that this was about “bringing a voice to people who have had no voice and that is what the church does.” 

It was wonderful spending time with Polly Tommey, who conducts the interviews on behalf of CHD. Polly’s unending energy, compassion and love are a beautiful sight to behold. Her commitment to validating every person’s experience is unmatched. She told one of our HEALNC leaders that she won’t stop until she has been all over the country and has given everyone with a story to tell the platform to be heard. It was truly amazing to witness her compassion and her ability to stay engaged day after day.

Though many of the stories were heartbreaking, there was a spirit of community that was palpable. Everyone was thrilled to be with like-minded people who were eager to listen and who actually believed them as they testified about their experience. Sadly, many of those who have been injured by the medical system are ignored, ridiculed, or made to feel crazy. 

Several people who knew nothing about the Informed Consent movement stopped to speak with us. One was a mother with her four children who had just picked up food from the food bank operated out of the church where the bus was parked. When she walked up to us, she was guarded but curious about our purpose. We answered her questions and then introduced her to the wonderful Dr. Anne Hines. Once Dr. Hines engaged with her, this mother let down her guard and shared with us that her daughter has autism. We sent the newly informed family home with a copy of Vaxxed 2 and CHD T-shirts for all.

Dr. Hines wasn’t the only doctor who stopped by. Cancer researcher, David Rasnick, PhD, shared what he’s learned about Turbo Cancer. Veteran health freedom advocate, Dr. Cammy Benton, is under investigation by the medical board for prescribing ivermectin. She shared what it was like Treating Covid Patients and the current status of the medical board investigation. Dr. Mark Barrett, about whom we recently wrote, is perhaps the newest pediatrician in NC to promote medical freedom. He also shared his story of awakening with Polly: I Am a Pediatrician.

We were surprised by the number of people who reported death or injury caused by hospital protocols. In fact, Polly said the protocol injuries and death were the most common type of story told in her travels so far. That proved to be true in North Carolina as well:

We also heard a heart wrenching story from a brave mom whose 10-year-old daughter was killed by the HPV vaccine. She is part of the HPV lawsuit in the NC courts. Her recording will not be released until it’s approved by her attorney.

It is always heartening to hear stories from parents and loved ones who became aware of vaccine injury and the dangers of vaccination and no longer vaccinate their children. Unfortunately, that often happens after one or more of their children have been injured. Hearing from parents who have seen the difference in health outcomes between their vaxxed and unvaxxed children is fascinating and reinforcing:

Why Are People Filing HPV Vaccine Cases Against Merck?

The HPV vaccine has wreaked havoc on thousands of children and young adults on a worldwide scale with very little, if anything, to show for being exposed to Gardasil’s considerable risks. Many people with HPV vaccine claims pending in North Carolina continue to suffer from a myriad of autoimmune diseases and other serious side effects years after receiving the Gardasil vaccine. How does Gardasil cause these autoimmune injuries?

Gardasil has components that are so similar to human cells that when a vaccinated person’s immune system generates antibodies and immune cell responses to Gardasil, the immune cells and antibodies attack the vaccinated person’s human cells while also attacking Gardasil’s antigen. When the attacked human cells are linked to key cardiovascular, neurological, and ovarian receptors, they can be damaged, and once damaged, those systems can go haywire—persistent autoimmune conditions.

This process, known as molecular mimicry, is now well recognized among immunologists. As a result of programs like the human DNA project or the human microbiota project, teams of scientists have been mapping the amino acids comprising the proteins in human organ systems, bacteria, viruses, and other pathogens. Computerized mapping has shown very similar if not identical amino acid sequences between HPV’s proteins and key human proteins. Immune systems identify pathogens by their amino acid sequences, and once an amino acid sequence is associated with a pathogen like HPV, the immune system’s antibody, and cellular defenses attack that amino acid sequence, whether it’s the shell of an HPV virus or a receptor on the surface of a human heart cell.

Gardasil’s HPV virus-like particles are intended to create an immune response against live HPV strains if encountered in “the wild,” which under normal circumstances would not result in autoimmune conditions. However, Gardasil has special immune-stimulating aluminum and other components that induce immune responses more than 40 times greater than a “wild” HPV virus. The combination of this boosted immune response with the similarity between human cells’ and HPV’s amino acids overwhelms the normal system for dealing with that similarity, and the vaccinee’s immune system can go on a persistent, and sometimes devastating attack leading to debilitating autoimmune diseases.

Who Can File an HPV Vaccine Case?

Gardasil lawyers represent claimants with the following diagnoses:

Nearly all of these conditions are difficult to diagnose, so if you suspect that you are having a reaction to the Gardasil vaccine, talk to a medical professional as soon as you are able. Resources for getting care can be found at the bottom of this article.

What is the Process for Filing an HPV Vaccine Claim?

The National Vaccine Injury Compensation Program (NVICP), also known as “Vaccine Court,” allows petitioners to seek monetary compensation for allegedly suffering injury or death after receiving a covered vaccine. The program is intended to provide individuals with a “swift, flexible, and less adversarial alternative to the often costly and lengthy civil arena of traditional tort litigation.”

If you meet certain medical requirements and file within a time limit known as your statute of limitations (more information on this below), you may be able to file a petition with the NVICP.

If the requirements are met, an HPV vaccine claim proceeds as follows:

• A vaccine-injured individual retains an attorney to represent their interests in court.
• The attorney submits a petition to the Vaccine Court, along with a witness statement of what occurred, and a medical chart.
• The U.S. Department of Human and Health Services (HHS) reviews the petition and determines if the claim meets the criteria for compensation.
• HHS then makes a preliminary recommendation on the petition to the U.S. Justice Department. The government’s recommendation is submitted to the Federal Court of Claims.
• A special master reviews the report and determines if the petitioner should receive compensation. The special master’s decision may be appealed if the petitioner chooses.
• If the petitioner rejects the Court’s decision or withdraws their claim after certain timelines are met (240 days), the petitioner may pursue a lawsuit in civil court against the vaccine manufacturer and/or the healthcare provider who administered the vaccine.
• If you do not receive approval for compensation or choose not to accept the settlement, your attorney can prepare a lawsuit on your behalf in civil court.

What is the Statute of Limitations for HPV Vaccine Cases?

HPV vaccine cases are governed by a strict statute of limitations of three years from the first onset of symptoms after vaccination. This means that you must file a claim within three years of any side effects after vaccination (a full list of post-Gardasil side effects can be found here). Most people with HPV vaccine claims report one or more side effects within a matter of months after vaccination, though this is not always the case. 

Of course, many people who suffer post-vaccination side effects are not aware that the harm they suffered may be related to the vaccine. As a result, many people miss their window to file a claim and are barred from pursuing a claim.
